HON. JOHN P. DIBLASI AUTHORS ARTICLE FOR THE NEW YORK LAW JOURNAL SPECIAL REPORT ON ADR

Hon. John P. DiBlasi NAM is proud to announce that Hon. John P. DiBlasi’s article entitled When Drafting An Arbitration Clause, Specificity Matters, was published by the New York Law Journal on Monday, November 28, 2016 as part of its Alternative Dispute Resolution Special Report.

In the article, Judge DiBlasi addresses the use of arbitration clauses in contracts and the many considerations that should go into drafting the clause, including: the type of disputes that will be the subject of the arbitration, providing for mediation prior to arbitration, the right to award attorneys’ fees, the selection of an ADR provider/administrator, providing for relief when a party does not cooperate and the use of a single arbitrator versus a tri-panel. Judge DiBlasi states, “The singular goal is to be as specific as possible to avoid litigating the very provision itself and delaying the ADR process.”
