NAM PRESIDENT AND CEO, ROY ISRAEL, CONTRIBUTES INSIGHTFUL PERSPECTIVE TO ARTICLE ON GROWTH OF ADR
Roy Israel , NAM President and CEO, conveyed his insightful point-of-view in an article about the rising popularity of alternative dispute resolution entitled “Not Just For Couples Anymore.” The Long Island Business News article written by Adina Genn notes that, in the not so distant past, mediation and arbitration had been mainly used in the world of divorce. The growth of ADR has been exponential and applies to all matters of the law which Mr. Israel knows firsthand. He founded NAM (National Arbitration and Mediation) in 1992. Back then, he recognized that ADR was a time efficient and cost-effective alternative to litigation. Today, in New York alone, more than 8,000 cases are submitted to NAM every year, signifying very rapid adoption of arbitration and mediation.
In the article, Mr. Israel points out the importance of settling claims in an expeditious manner and states, “The quicker it’s resolved, the quicker you can go back to business…these disputes can be a tremendous distraction to your business”. He observes that increasingly, companies are now putting pre-dispute arbitration provisions in employment contracts, so if there are disputes, they can be resolved through arbitration. He notes that these provisions are now being written into consumer contracts as well.
Mr. Israel also emphasizes the importance of selecting the best neutral for each case, as this can greatly influence the outcome of the matter.
