LAWLINE CLE: MAXIMIZING YOUR POTENTIAL FOR SUCCESS AT MEDIATION

Join NAM (National Arbitration and Mediation) neutral, Honorable John P. DiBlasi (Ret.), in a pre-recorded Lawline seminar, entitled Maximizing Your Potential For Success At Mediation.

Given the cost in terms of time, expense, and uncertainty of litigating in the court systems in both the United States and overseas, Alternative Dispute Resolution (ADR) has experienced phenomenal growth as an effective way to resolve litigation. This course will focus on how to fully maximize the benefits of the ADR process and the fundamental concepts of successfully representing the client. The presentation will focus specifically on the mediation modality of dispute resolution.

The lecture will include an extensive overview of the following:

    • Preparing for a Mediation
    • Understanding the Creation of Parameters
    • Writing a Mediation Brief
    • Preparing a Client for the Mediation
    • Making the Best Use of the Joint Session
    • Communication of the Settlement Position
    • Break-Out Sessions – Working Effectively with the Mediator
    • Breaking an Impasse
    • Preparing the Settlement Agreement
    • Continuing Negotiations Post-Mediation
