Mediation has become an essential and widely used method for resolving legal disputes, offering a faster and more cost-effective alternative to traditional litigation. Mediation empowers parties to shape outcomes on their own terms while avoiding the costs, delays, and uncertainty of trial. NAM Hearing Officers, Jacqueline B. Stein, Esq. and the Hon. Marsha L. Steinhardt (Ret.), will explore the  benefits of mediation and share practical strategies for guiding clients through the process.

The presenters will also examine how mediating complex legal matters, such as those involving technical subject matter, require a more nuanced approach than typical personal injury or general civil cases. NAM's presenters will provide valuable insights into the mediation process, including preparation tips, managing expectations, and navigating challenges to achieve successful resolutions.

Meet NAM's Presenters

Jacqueline B. Stein, Esq. has been engaged in the practice of law for more than 30 years with a focus on medical malpractice litigation, hospital claims management, and judicial mediation. During her years of practice, Ms. Stein has handled all aspects of medical malpractice litigation and has successfully negotiated and settled hundreds of cases. She has participated in numerous pre-litigation investigations at the request of hospitals and has had substantial experience in the analysis of liability, exposure, and settlement negotiations. Ms. Stein has arbitrated and mediated hundreds of medical malpractice and hospital claims providing her with a deep understanding of the intricacies involved in the evaluation and settlement of these disputes. As a result of her success in this area, Ms. Stein has earned the respect and confidence of both the plaintiff and defense bars. Ms. Stein is available to mediate and arbitrate cases throughout New York State.

Hon. Marsha L. Steinhardt (Ret.) is a member of NAM's (National Arbitration and Mediation) Hearing Officer Panel. Her remarkable 31-year judicial career includes 26 years spent as a Justice of the Supreme Court in the state of New York. She was assigned to the Medical Malpractice Trial Readiness Part, Kings County, where she conferenced every post Note of Issue medical malpractice case in Brooklyn, resulting in the resolution of a significant number prior to trial. While on the Supreme Court bench, she also presided over many case types, including personal injury, product liability, premises liability, and several matters involving complex commercial litigation. Justice Steinhardt is available to arbitrate and mediate cases throughout the New York State.
