NAM and the New York State Trial Lawyers Association recently presented a CLE webinar featuring NAM Hearing Officers James W. Borkowski, Esq. and Mitchell R. Kahn, Esq. The program, “Excelling at Labor Law 240 and 241(6) Mediations,” was moderated by Helina Manesis, Esq., of Zaremba Brown, PLLC. The presenters provided a behind-the-scenes look at the mediation process as it relates to labor law cases.

New York State Labor Law Section 240 holds owners and general contractors strictly liable for injuries and sequelae from height-related accidents, including falls from ladders and scaffolds. Labor Law 241(6) requires that employers provide “reasonable and adequate protection and safety” to all employees performing “construction, excavation, or demolition work.” Labor Law 240 and 241 (6) cases are high stakes for both sides, making mediation all the more important. 

Proper preparation is vital to the successful resolution of these types of matters. The presenters provided insights into the mediation process with an emphasis on preparation, including premediation discussions, submissions and what a mediator is looking for to facilitate the resolution.

Having regularly appeared in the courtrooms of all five boroughs, as well as Nassau, Suffolk, Westchester, and Rockland counties, Mr. Kahn applies his extensive experience when hearing mediations to aid in the fair and expedient resolution of cases. Mr. Kahn has handled all aspects of Labor Law 240 and 241 cases and has successfully mediated numerous multi-million-dollar catastrophic personal injury matters. Mr. Kahn is available to mediate cases throughout New York State.
