Lubell is a former Justice of the Supreme Court of the State of New York with over two decades of judicial experience presiding over complex civil, matrimonial, medical malpractice, commercial, construction, insurance, product liability, personal injury, real estate, zoning, foreclosure, and contract matters. During his judicial tenure, Justice Lubell conducted trials, mediations, arbitrations, settlement conferences, and other proceedings throughout New York’s 9th Judicial District, Bronx County, and New York County.
Justice Lubell was elected to the Supreme Court in November 2005 and took the bench in January 2006. He initially served in a general individual assignment system part in Orange County, handling civil matters from filing through resolution or trial. Later that year, he was assigned to the Matrimonial Part in Westchester County, where he presided over matrimonial and post-judgment proceedings.
In 2009, Justice Lubell returned to Orange County and presided over a general individual assignment system part encompassing personal injury, medical malpractice, commercial, contract, foreclosure, matrimonial, and other civil matters. He was assigned to Putnam County in 2011 and designated District Backup Supreme Court Civil Trial Judge for the 9th Judicial District. In that capacity, he presided over assigned civil cases and complex trials throughout Dutchess, Orange, Putnam, Rockland, and Westchester counties.
Justice Lubell returned to Westchester County in 2016 and was appointed Supervising Judge for Matrimonial Matters for the 9th Judicial District in 2017. He supervised matrimonial and post-judgment matters throughout the district, coordinated the Matrimonial Trial Ready Part, and addressed related motion practice and case-management issues. In 2021, he was appointed Districtwide Coordinator for General Civil Matters. In that role, he served as a liaison between the Administrative Judge and the district’s Civil Supreme Court judiciary, presided over the Trial Assignment Part, and handled medical malpractice matters, settlement conferences, mediations, arbitrations, and complex civil trials. In August 2025, Justice Lubell was appointed Supervising Judge of the Westchester County Settlement Part where he conducted settlement conferences, carrier settlement days, mediations, and bench trials until his retirement from the bench at the end of July.
Before joining the Supreme Court, Justice Lubell served as Acting Village Justice for the Village of Ardsley. He presided over criminal and civil proceedings, including hearings, trials, settlement conferences, arraignments, bail determinations, small claims matters, and landlord-tenant disputes.
Justice Lubell also spent more than a decade in private practice as a trial attorney. His experience included medical and dental malpractice, nursing home liability, pharmaceutical and product liability, serious personal injury, governmental and municipal liability, insurance defense, commercial disputes, and appellate matters. He also worked on litigation arising from several major aviation disasters, including TWA Flight 800, Swissair Flight 111, EgyptAir Flight 990, and American Airlines Flight 587, and participated in related multidistrict litigation proceedings.
While attending law school, Justice Lubell worked with the New York City Law Department’s Office of the Corporation Counsel and the Office of the Nassau County Attorney. Under attorney supervision and applicable practice orders, he handled tort and civil rights matters, conducted examinations and statutory hearings, drafted and argued motions, participated in settlement conferences, and represented governmental entities in court proceedings.
Prior to entering the legal profession, Justice Lubell had an extensive career in sales and senior-level corporate management. This experience provides him with an understanding of the business, financial, and operational considerations that may affect the evaluation and resolution of a dispute.
Justice Lubell is a Fellow of the National Courts and Science Institute and the Advanced Science and Technology Adjudication Resource Center. Through these programs, he received advanced judicial training concerning scientific and technological evidence, Frye and Daubert hearings, genetics, neuroimaging, and other novel or developing scientific issues. He has lectured extensively at continuing legal education programs and judicial training courses and has served as a judge and participant in moot court, mock trial, mock arbitration, and appellate advocacy programs.
Judge Lubell is available to arbitrate and mediate cases throughout New York.
