Mr. Kohane has mediated over one hundred matters, with a 70 – 75% settlement rate, and has arbitrated personal injury and insurance coverage cases. He is a certified mediator and neutral for the United States District Court for the Western District of New York, mediates court-annexed matters across multiple New York judicial districts, and serves as a Special Master in a Mandatory Civil Appeals Mediation program of the New York State Appellate Division, Second Department. His ADR work also reaches appellate practice, attorney malpractice and legal ethics, construction and construction defect, employment law, hospitality, negligence and torts, professional liability, and property damage matters. He has mediated complex Labor Law risk transfer, first and third-party coverage disputes including construction defect claims, commercial, premises, motor vehicle, product liability and other personal injury cases, first, third party insurance coverage.
Mr. Kohane has practiced law in Buffalo, New York and throughout the State of New York for more than four decades, having extensive trial experience in New York State Labor Law, motor vehicle, premises and personal injury matter and has a concentration on insurance coverage, risk transfer and counseling. He advises insurers corporate clients, and policyholders on coverage analysis, extra-contractual liability, bad faith, and complex excess matters, with particular depth in New York insurance law, including its application under the Bermuda Form. He has handled coverage matters through the appellate courts and has been retained as an expert witness in the United States, Canada, and the United Kingdom.
An educator by avocation, Mr. Kohane has taught insurance law as an adjunct professor at the University at Buffalo School of Law for nearly four decades and has presented more than 250 continuing legal education programs. He is a member and founding regent of the American College of Coverage Counsel, a member of the American Law Institute, and has authored the Syracuse University annual survey of New York insurance law and numerous articles on coverage and dispute resolution.
